Do both married spouses have to file bankruptcy together?

No. Either spouse can file by themselves, both can file jointly, or the couple can each file separately at the same time. Usually, if only one spouse is obligated for most of the problematic debt, then only that spouse should file.

In particular, in Florida, if only one spouse holds most of the debt, there may be significant options to protect jointly owned marital assets. If you think you might be in this category, you should speak to us or another smart bankruptcy attorney.
